Cyber Forensics And Digital Evidence Certification (U/s 63(4)(C) of B.S.A 2003 Act Part-B
As per Bharatiya Sakshya Adhiniyam (BSA), 2023
Section 63(4)(c) of the Bharatiya Sakshya Adhiniyam (BSA), 2023, mandates a certification process for electronic records, similar to the previous Section 65B(4) of the Indian Evidence Act. This process ensures the admissibility of digital evidence in court by verifying its authenticity and reliability. Specifically, the certificate must be signed by a person in charge of the computer or communication device and an expert, and it must address matters related to the conditions in Section 63(2)
In essence, Section 63(4)(c) provides a framework for ensuring that digital evidence is reliable and admissible in court, by requiring a specific type of certification to verify its authenticity and accuracy.
